The cost-cutting measure might not be a problem for you. (Most taxpayers file electronically or download forms through IRS.gov, or get them through tax-prep software.) But an elder you know might need some help.<br>&nbsp;<br>"I think it's unfortunate," said one caller, Vlasta Barber, 85, of Tigard. She retired in 1984 after a 30-year career with, of all places, the IRS. Though Barber and her husband have a computer, she says they prefer paper forms. "I guess we're just old-fashioned." (She's not the only <a href="http://blog.oregonlive.com/finance/2011/04/not_all_income_tax_filers_want.html">ex-IRS employee who feels inconvenienced</a>.)<br>&nbsp;<br>Most public libraries carry paper tax forms. So do many post offices. <a href="http://www.oregonlive.com/finance/index.ssf/2012/01/tax_tips_2011_where_to_get_for.html">An item on my blog</a> offers other ways of ordering them. Check <a href="http://www.oregonlive.com/finance/index.ssf/2012/02/2011_oregon_and_federal_tax_fo.html">this list</a> and my <a href="http://bit.ly/fageBP">tax help bundle</a> to download them online.<br>&nbsp;<br>In December, the <a href="http://www.oregon.gov/DOR/">Oregon Department of Revenue</a> mailed more than 100,000 paper forms to taxpayers who filed by mail last year, said department spokesman Derrick Gasperini. If you filed electronically, you won't get Oregon forms in the mail.<br>&nbsp;<br>Incidentally, the state has done away with its simple, abbreviated form; those filers will file <a href="http://media.oregonlive.com/finance/other/Oregon_Form_40.pdf">Form 40</a> instead this year. "There is no 40S form this year," Gasperini said.<br>&nbsp;<br>Also, don't forget, the federal filing deadline is later than usual again this year -- April 17. Oregon returns are due the same day. This is thanks to <a href="http://blog.oregonlive.com/finance/2011/01/dcs_emancipation_day_frees_tax.html">Emancipation Day</a>, a holiday observed in the District of Columbia.<br>&nbsp;<br>A couple of other topics from my inbox this week:<br>&nbsp;<br><div align="center"><b>LTCs and the IRS</b><br></div><br>Stephen Cohen, a licensed tax consultant in Portland, took issue with <a href="http://www.oregonlive.com/finance/index.ssf/2012/01/oregon_land_of_many_well-train.html">my assertion two weeks</a> ago that only CPAs, enrolled agents and attorneys could represent taxpayers before the IRS.<br>&nbsp;<br>"I do it all the time," Cohen wrote in an email. "If I prepared and signed a return, the IRS will discuss it with me.<br>&nbsp;<br>"If a client of mine is under IRS examination, I again can talk directly with IRS."<br>&nbsp;<br>He's correct -- as long as he's signed the return being discussed, federal rules and tax experts say. However, federal rules bar LTCs and other registered tax preparers from representing clients before IRS appeals or revenue officers. (The latter do collection work.) The exception is if the LTC is also an enrolled agent, attorney or CPA.<br>&nbsp;<br>So an LTC can communicate with the IRS on a client's behalf for most purposes, including during audits, but not during appeals or collections or to help a nonclient get out of trouble.<br>&nbsp;<br><div align="center"><b>Is this CD for real?</b><br></div><br>Maybe you've seen <span id="asset-10522172"><a href="http://media.oregonlive.com/finance/other/Sun_Cities_Ad.tiff">the ad</a></span>: A federally insured, six-month certificate of deposit paying 2.15 percent annual percentage yield.<br>&nbsp;<br>Three readers have asked me and the Oregon Department of Justice: Is this offer for real? Most banks won't even pay that kind of rate for a five-year CD.<br>&nbsp;<br>"I got to wondering just where did they make their money," said Clyde Knowles of White Salmon, Wash., who filed a written inquiry with Oregon Attorney General John Kroger's office.<br>&nbsp;<br>It's for real, says Jack Zakrzewski, an account rep for <a href="http://www.scfg.com/">Sun Cities Financial Group Inc</a>. in Lake Oswego, which took out the ad. As described in its fine print, Sun Cities will deposit your money ($25,000 minimum) in a bank that offers a CD paying a 1 percent APY. Sun Cities then pays you a bonus equal to 1.15 percent APY. That comes via a check about 15 days after the deposit.<br>&nbsp;<br>I figured a six-month, 1.15 percent interest bonus on $25,000 to be $144. That's on top of the $125 you'll earn from the CD.<br>&nbsp;<br>"Typically that's what we advertise because it works out well for us," Zakrzewski said. "It's a promotional rate."<br>&nbsp;<br>The catch comes down the road. When the CD matures, you can't renew and get that bonus interest rate. You might not even get the 1 percent rate without picking a longer maturity.<br>&nbsp;<br>Instead, you'll most likely be reminded of the other products Sun Cities sells: annuities.<br>&nbsp;<br>Arizona-based Sun Cities is an insurance broker licensed to sell life insurance and annuities in Oregon, said <a href="http://insurance.oregon.gov/">state Insurance Division</a> spokeswoman Cheryl Martinis. It makes its money from commissions on the annuities it sells, Zakrzewski confirmed.<br>&nbsp;<br>"We offer both CDs and fixed and indexed annuities," Zakrzewski said. "I will usually show (customers) a selection of what's available. You choose what you like. No quid pro quos."<br>&nbsp;<br>Annuities offer higher rates, in part because they require you to lock up your money for much longer, often for life. The higher rates will be tempting shown alongside CD rates.<br>&nbsp;<br>Annuities can be attractive for people who want a guaranteed income stream. It's generally not a good idea, however, to put the bulk of your retirement savings in annuities. In fact, it could be entirely inappropriate, depending on your age and assets.<br>&nbsp;<br>Also, indexed annuities are riskier than CDs. They have potentially higher payouts, but you can also lose money on them. Their indexing features are complicated, and they're embedded with hidden costs. CDs aren't.<br>&nbsp;<br>A lot of retirees these days are searching for safety and yield.<br>&nbsp;<br>"I've been swamped, actually," Zakrzewski said. "People in Oregon seem to be a bit more conservative, a bit more cautious."<br>&nbsp;<br>So, please: Tread carefully. <a href="http://www.oregonlive.com/finance/index.ssf/2012/01/best_cd_rates_in_oregon_in_201.html">Know your options</a>. A longer-term CD with a low early withdrawal penalty might be just as good.<br>&nbsp;<br>"If you want federally insured certificates of deposit," said Greg McBride, senior financial analyst with <a href="http://bankrate.com/">Bankrate.com</a>, "the closest you'll get to a free lunch is comparison shopping the top yields available nationwide and investing directly with the bank."<br><br><br>-- <b>Read It's Only Money</b> <a href="http://orne.ws/2011-taxes">past columns and posts on 2011 tax issues</a>. <br>

owners, has extended by two months the&nbsp;deadline to electronically 
file&nbsp;employee wage-and-tax statements.<br><br></div>This year, for the first time, the state required all businesses file 2011 <a href="http://www.irs.gov/pub/irs-pdf/fw2.pdf">W-2 
forms</a> electronically with the revenue department by March 31. In previous years, only larger 
businesses were required to file electronically.</div>
<div><br>Hundreds of small businesses have called the department about the new requirement in the last two weeks, spokesman Derrick Gasperini said today. They were either unaware it or&nbsp;lack the software to deliver the statements 
electronically, he said.<br><br>The department is&nbsp;designing a free site called iWire Direct where businesses can manually enter the W-2 
information. But it won't be ready until mid-March. So the department has 
extended the deadline for filing those statements to May 31.</div>
<div><br>Gasperini said the extension won't delay worker tax refunds. The department

				Remember the experts' picks for 2011? Don't worry. They don't want you to. <br><br>The folks at Vista Capital Partners in Portland took a look at predictions put forth by Barron's, Forbes, Fortune, SmartMoney and the Wall Street Journal for 2011. The resulting article is titled "<a href="http://www.vistacp.com/2012/01/warning-for-entertainment-purposes-only/">Warning: For Entertainment Purposes Only</a>." <br><br>Which is exactly how most of us should take these prognosticators (along with CNBC's Jim Kramer). Writes Vista's Dougal Williams:<br><br><blockquote><span class="post-excerpt">"It&#8217;s all a game.&nbsp; A charade.&nbsp; A ploy to sell 
more magazines and line Wall Street&#8217;s pocket with fees.&nbsp; So, with this 
year&#8217;s stock market guides now hitting stores, we think a review of last
 year&#8217;s predictions might provide investors with the necessary caution."</span><br></blockquote><br>Research has shown that experts get it wrong more frequently than they get it right, and that active money managers underperform their passively managed benchmark. You can invest in most benchmarks via an index fund.<br><br>Elsewhere:<br><br><b>Fraud, unpunished:</b> The New York Times shows how <a href="http://www.nytimes.com/2012/02/03/business/sec-is-avoiding-tough-sanctions-for-large-banks.html?_r=1&amp;pagewanted=all?src=tp">the SEC has allowed JPMorgan Chase</a> and other big banks to avoid tough sanctions following fraud investigations:<br><br><blockquote>"JPMorganChase, for example, has settled six fraud cases in the last 13 years, including one with a $228 million settlement last summer, but it has obtained at least 22 waivers, in part by arguing that it has 'a strong record of compliance with securities laws.' Bank of America and Merrill Lynch, which merged in 2009, have settled 15 fraud cases and received at least 39 waiver."<br><br></blockquote><a href="http://www.nytimes.com/interactive/2012/02/02/business/Giving-Wall-Street-a-Break.html">Here's a timeline</a> of these waivers, normally reserved for "the most dependable companies." It's outrageous. Seriously, with tepid such repercussions, these companies can merely budget for such fines as a cost of doing business and keep doing whatever they want. <br><div><br><b>Investing warnings</b>: The Financial Industry Regulatory Authority <a href="http://www.finra.org/web/groups/industry/@ip/@reg/@guide/documents/industry/p125492.pdf">warned investors</a> this week against chasing yields, <a href="http://www.investmentnews.com/article/20120201/FREE/120209992">Investment News notes</a>. It says they might be taking on risk they don't understand. This is especially true if you're switching from CDs to variable annuities, nontraded REITs and privately placed stocks. Broker-dealers are peddling these and get robust fees for them. "We remain concerned about firms charging retail investors hidden, mislabeled or excessive fees," FINRA said.<br><br><b>Taxes</b>: Corporate tax receipts as a share of corporate profits fell last year to 12 percent -- the lowest level in 40 years, <a href="https://twitter.com/#!/JohnWDean/status/165267762640461825/photo/1">the Wall Street Journal reports</a>. Some actions that consumers take prior to filing for bankruptcy in Oregon can have profound effects on the bankruptcy case once it is filed. Here is a common list of things that consumers should avoid doing once they decide to file for bankruptcy.</p>

<li>Don’t sell, give away or transfer ownership of any personal property, real estate, or other property prior to filing your bankruptcy case.</li>
<li>Don’t use credit cards or incur more debt.</li>
<li>Don’t leave assets off your bankruptcy forms, including lawsuits, workers comp claims, or other possible cases you may have.</li>
<li>Don’t take money out of retirement plans, IRAs, or 401Ks</li>
<li>Talk to your lawyer if you are expecting a large tax refund.</li>
<li>Don’t put your money into someone else’s bank account or put your name on someone else’s account.</li>

The aim is to help people get used to filing their own returns online, Justus said.<br><br>"It's something the IRS is really promoting," Justus said. "Our biggest issue, frankly, is capacity. Our numbers just continue to grow. <p>Once the courts grant an application, several things happen very quickly. In the case of businesses, all trading ceases immediately and the employees are retrenched. Assets of both individuals and businesses are seized and preserved for sale. The court will appoint a trustee, whose task it is to see that the entire matter is brought to a conclusion as soon as possible.</p>
<p>When a business enterprise makes an application for insolvency, the trustee has several options. In some cases it is deemed in the best interest of all parties to allow the business to keep trading. In such cases, all income generated will be controlled by the trustee or the administrator that reports to him. It may also be decided to sell the business as a going concern, or to strip the assets for the purpose of sale on an open auction.</p>

"This
 agreement penalizes banks that engaged in wrongful foreclosure 
practices and brings badly needed relief for distressed homeowners." <br><br><a href="http://www.google.com/hostednews/ap/article/ALeqM5jbNIXAfTh6u1xrcRKO7i-7BX_FVQ?docId=21c3104a82714dc08bce92b459bd154c">The proposed settlement</a> would net the state $30 million and give Oregonians who believe they've been wronged during a foreclosure checks for up to $2,000. It would also set aside at least $100 million to help "underwater" homeowners with principal reductions and refinancings. <div style="margin-bottom:8px;">Oregon Attorney General John Kroger has <a href="http://bit.ly/AtdQQo">set up a website</a> for homeowners to request more information about the settlement as it becomes available. He also has <a href="http://www.doj.state.or.us/homeowners/faqs.shtml">a question-and-answer page</a> about the proposed deal.</div></div>It reportedly would waive Oregon's right to bring civil lawsuits against the servicers for their foreclosure practices. But it does not bar Oregon or other states from pursuing how mortgages might have been improperly securitized -- that is, bundled together and sold to investors.<div><br></div><div>It also would not impact homeowners' rights to sue servicers in court. And it allows states to pursue criminal charges against the banks, if necessary. <br><br>The fate of the agreement remains unresolved, however. State attorneys general in California and Delaware have publicly rejected the settlement, saying it won't protect enough distressed homeowners. Ultimately, a federal judge must approve the agreement, possibly late this month, Kroger's chief of staff Keith Dubanevich said.</div><div><br></div><div>Dubanevich said 18 states have signed on to the agreement. The deadline for signing on is Monday.&nbsp;</div><div><br>A spokesman for Iowa Attorney General Tom Miller, who spearheaded the settlement talks, confirmed this morning that other states have signed on to the agreement, though he would not say how many.&nbsp;</div><div><br>"I
 think it's safe to say that AGs who helped negotiate the proposed 
settlement, including my attorney general, support the agreement," Miller's spokesman Geoff Greenwood said. <br><br>The Associated Press has reported the settlement will cost the servicers -- Bank of America Corp., Wells Fargo &amp; Co., JPMorgan Chase &amp; Co., Ally Financial Inc. and Citigroup Inc. -- up to $25 billion, depending on how many states sign on to the agreement.</div><div><br></div><div>Dubanevich provided new details of the settlement, which hasn't been released publicly He said it establishes new protections for homeowners in the form of 42 pages of servicing standards.&nbsp;</div><div><br></div><div>The standards prohibit the servicers from conducting a foreclosure sale while considering homeowners for a modification &nbsp;-- the so-called "dual-track problem." It also requires servicers to be clear and responsive to homeowners when they ask who owns their loan, Dubanevich said.&nbsp;</div><div><br></div><div>A national monitor will oversee compliace with the standards, Dubanevich said, and a federal judge also will ensure banks comply.&nbsp;</div><div><br></div><div>However, many homeowners won't be covered by the agreement. Smaller servicers have not signed on to the pact. It covers mortgages held privately during 2008 and 2011, but not those owned by government-sponsored Fannie Mae and Freddie Mac. &nbsp;Fannie and Freddie own about half of all U.S. mortgages, roughly about 31 million U.S. home loans, according to the AP.
&nbsp; &nbsp;&nbsp;</div><div><br></div><div>"This is just one of many steps that have to be taken before we completely clean up the housing and financing industry," Dubanevich said today. "There are plenty more financial institutions out there we&#8217;ll turn our attention to."</div><div><br></div><div>Consumer advocates reaction to Kroger's announcement was mixed.&nbsp;</div><div><br></div><div>Angela Martin, executive director of advocacy group <a href="http://www.economicfairnessoregon.org">Economic Fairness Oregon</a>, said she agreed with Kroger's decision and called on legislators to put the state's $30 million payment toward foreclosure-relief and prevention programs.</div><div><br></div><div>"I don&#8217;t believe we get a better deal by holding out for a larger settlement or a different settlement down the road," Martin said. "Once the money arrives in Oregon, we need to make sure we spend it strategically."</div><div><br></div><div>Nancie Koerber, co-founder of Central Point homeowner advocacy group&nbsp;<a href="http://goodgriefamerica.ning.com/">Good Grief America</a>, called last week for Kroger to hold off and further investigate the finance industry.&nbsp;</div><div><br></div><div>"These guys have done things that are deep and dark," Koerber said. "We don&#8217;t think settling is a good choice for homeowners or the economy."<br> <div><br>Late last week, <a href="http://www.oregonlive.com/business/index.ssf/2012/01/oregon_ag_kroger_issues_emerge.html">Kroger issued temporary rules</a> detailing behaviors by servicers that violate state consumer protection laws, giving homeowners and the state another weapon in court in wrongful foreclosure cases. The Oregon Legislature, which convened today, will consider permanently adopting <a href="http://www.oregonlive.com/business/index.ssf/2012/01/oregon_ag_kroger_issues_emerge.html">even tougher standards</a> for all servicers, not just the top five.&nbsp;<br><br>Since
 2008, Kroger's office has received 1,700 <a href="http://www.doj.state.or.us/finfraud/">complaints</a> about loan 
servicers, making it the 4th most complained-about industry in that 
time, the department says.&nbsp;</div><div><br></div><div><a href="http://www.atg.wa.gov/Default.aspx">Washington State Attorney General Rob McKenna</a> helped negotiate the agreement.
